Terms of Service – All-Air Heating & Air Conditioning
Introduction and Overview of Services
Welcome to All-Air Heating & Air Conditioning. We are a California-based, family-owned company providing residential heating, ventilation, and air conditioning (HVAC) services, solar panel installation, and indoor air quality solutions. Our services include routine maintenance, repairs, new system installations, duct services, temperature zoning, and solar energy systems. These Terms of Service (“Terms”) govern your use of All-Air Heating & Air Conditioning’s services and website. By scheduling a service or using our website, you agree to these Terms. We are committed to delivering high-quality service to our customers throughout Lodi, Stockton, Tracy, Elk Grove, Manteca, Galt, Sacramento, Lathrop, Modesto, Livermore, and surrounding communities in accordance with California law and industry best practices.
Payment Policies
Third-Party Payment Processing: All payments for our services are processed securely through a reputable third-party payment provider. All-Air Heating & Air Conditioning does not store your credit or debit card numbers on our systems. Your card information is transmitted over an encrypted connection to our payment processor, and we retain only necessary transaction records (such as receipt details). For security reasons, credit card information is not stored by All-Air Heating & Air Conditioning; it is processed by the third-party payment gateway on our behalf. This means that when you pay for services, your payment details are handled in a secure environment by the payment provider, and All-Air Heating & Air Conditioning does not have access to your full card number or security code.
Payment Terms: Payment terms vary by service type:
- HVAC Service Calls & Repairs: Payment for one-time service calls is typically due at the time the service is provided, with a standard $99 diagnostic fee (subject to promotional discounts). For larger HVAC installations, payment schedules are outlined in your service agreement.
- Solar Projects: Due to the extended nature of solar installations, payment is typically structured in milestone-based installments as described in your solar installation agreement. Common payment milestones include: (1) deposit upon contract signing, (2) payment upon permitting completion, (3) payment upon installation completion, and (4) final payment upon system activation and inspection approval.
- Maintenance Plans: For membership plan customers, payment is due according to the terms of your membership agreement (typically annual or bi-annual billing).
We accept various forms of payment (e.g., credit card, debit card, check, or wire transfer for larger solar projects) as indicated on your invoice or our website. Because we do not sell products through an online store, you will not be charged online through our site; instead, payments are arranged through invoices or point-of-service transactions handled by our third-party processor.
Financing Options
All-Air Heating & Air Conditioning itself does not offer in-house financing or credit programs. However, for larger projects (such as installation of a new HVAC system or solar energy system), we may refer you to third-party financing companies that provide payment plans, solar loans, or lease/PPA (Power Purchase Agreement) options. If you choose to apply for financing, you will do so directly through the third-party financer’s application process. Any personal information or financial details you provide in a financing application are submitted directly to the financing company and not to All-Air Heating & Air Conditioning. All-Air Heating & Air Conditioning does not receive, collect, or store the information you provide to financing partners, and such information is subject to the financer’s own terms and privacy policy.
Please note that approval decisions, interest rates, and payment terms for any financing are determined by the third-party financing provider, not by All-Air Heating & Air Conditioning. We are not liable for any issues arising from the financing process. If you have questions or concerns about a financing application or loan, you should contact the financing company directly.
Solar Incentives and Rebates: For solar installations, All-Air Heating & Air Conditioning may assist you in identifying available solar incentives, rebates, and tax credits (such as the Federal Investment Tax Credit). However, All-Air Heating & Air Conditioning makes no guarantees regarding your eligibility for, or the amount of, any incentives. The responsibility for claiming tax credits and incentives rests solely with you. We recommend consulting with a tax professional regarding your specific situation. All-Air Heating & Air Conditioning is not liable for any changes to incentive programs, missed deadlines, or denied claims.
Solar Installation-Specific Terms
Permitting and Approvals: Solar installations require various permits and approvals from local building departments, utility companies, and potentially homeowners’ associations. All-Air Heating & Air Conditioning will submit necessary permit applications and coordinate inspections as part of our standard installation process. However, approval timelines are controlled by third-party agencies and may vary. All-Air Heating & Air Conditioning is not responsible for delays caused by permitting or utility interconnection processes beyond our control.
Utility Interconnection: For solar systems, your local utility must approve the interconnection of your system to the grid and activate net metering (if applicable). All-Air Heating & Air Conditioning will submit the required interconnection applications and coordinate with the utility, but the utility’s timeline and approval are outside our control. Your system may be installed and ready for operation before utility approval; however, it cannot be activated until the utility grants Permission to Operate (PTO).
System Performance: Solar system energy production estimates provided by All-Air Heating & Air Conditioning are based on industry-standard modeling software using typical weather data, shading analysis, and system specifications. Actual energy production may vary based on weather conditions, shading changes, system maintenance, utility curtailment, and other factors outside our control. All-Air Heating & Air Conditioning does not guarantee specific energy production levels unless explicitly stated in writing in your installation agreement.
Equipment Warranties: Solar panels, inverters, battery storage systems, HVAC equipment, and other hardware come with manufacturer warranties separate from All-Air Heating & Air Conditioning’s workmanship warranty. Manufacturer warranty terms vary by product and typically cover defects in materials and workmanship for specified periods (commonly 10-25 years for solar panels, 5-15 years for inverters, 5-10 years for HVAC equipment). All-Air Heating & Air Conditioning will assist you in making warranty claims with manufacturers but is not responsible for manufacturer warranty coverage or performance.
Roof Warranty and Structural Considerations: Solar panel installation requires roof penetrations for mounting equipment. While All-Air Heating & Air Conditioning takes care to maintain roof integrity and seal all penetrations properly, we recommend having your roof inspected before installation if it is more than 10 years old. All-Air Heating & Air Conditioning is not responsible for pre-existing roof conditions, and if a roof requires replacement or significant repairs, solar installation should be postponed until roof work is completed. All-Air Heating & Air Conditioning’s workmanship warranty covers leaks caused by our installation work for the period specified in your installation agreement.
Maintenance of Service Records
As part of our service commitment, All-Air Heating & Air Conditioning maintains records of the services we perform for you. This includes keeping copies of work orders, job details/descriptions, invoices, service agreements or contracts, membership plan records, permit applications (for solar), interconnection agreements (for solar), and system monitoring data. We maintain these customer records to track service history, schedule routine maintenance, honor warranties, comply with regulatory requirements, and ensure we have accurate information to provide you with continuous support. By doing business with All-Air Heating & Air Conditioning, you agree that we may retain these records. We handle all customer records in compliance with applicable privacy laws and our Privacy Policy.
100% Satisfaction Guarantee and Refund Policy
All-Air Heating & Air Conditioning takes pride in the quality of our work.
For HVAC Repairs and Maintenance: We offer a 100% Satisfaction Guarantee on all HVAC repair and maintenance services. This means that if you are not fully satisfied with a repair or maintenance service we provided, we will make every reasonable effort to correct the issue. Simply contact us and let us know the problem, and we will work with you to resolve it—whether that involves re-servicing the equipment at no additional charge or taking other appropriate corrective action. If we cannot remedy the issue to your satisfaction, we will not charge you for that service or will refund any amount you already paid for it.
For HVAC Installations: Our satisfaction guarantee does not apply to new equipment installations, system replacements, or system upgrades. HVAC installations are governed by the terms outlined in your installation agreement. All-Air Heating & Air Conditioning warrants that installation workmanship will be performed in accordance with manufacturer specifications and applicable building codes. If a workmanship defect is identified within the warranty period specified in your installation agreement, we will correct the issue at no additional charge. Equipment installed (furnaces, air conditioners, heat pumps, thermostats, air quality systems, etc.) is covered by the manufacturer’s warranty and is non-refundable once installed. All-Air Heating & Air Conditioning will assist you in making any warranty claims with the manufacturer if equipment is defective, but refunds or replacements of equipment are governed by the manufacturer’s warranty terms. Cancellations of installation contracts are subject to the cancellation terms in your installation agreement, including charges for equipment ordered, labor performed, permits filed, and applicable restocking fees.
For Solar Projects: Due to the complex, multi-phase nature of solar installations involving permits, equipment procurement, and installation, the 100% Satisfaction Guarantee does not apply to solar installations. Solar projects are governed by the terms of your solar installation agreement. If you wish to cancel a solar installation contract:
- Before Work Begins: Cancellations made before any work has commenced or equipment has been ordered are subject to cancellation fees as specified in your installation agreement, typically limited to costs already incurred for design, engineering, or permit applications.
- After Work Has Begun: Once equipment has been ordered, permits submitted, or installation commenced, cancellation may result in charges for non-refundable equipment, labor already performed, permit fees, and restocking charges as detailed in your installation agreement.
- After Installation Completion: If installation is complete but you are unsatisfied with workmanship, we will correct any workmanship issues at no additional charge.
All-Air Heating & Air Conditioning’s workmanship warranty covers defects in our installation work for the period specified in your installation agreement. Equipment (solar panels, inverters, batteries, etc.) is covered by the manufacturer’s warranty and is non-refundable once installed.
Service Warranties: We offer a 2-year warranty on labor and parts for all HVAC repairs, as well as our comprehensive service guarantees including our “No Quacky Repairs Promise,” “First-Time Fix Promise,” and “Stay Cozy or Call Us Promise” as detailed on our website. These service guarantees apply to repair and maintenance services only.
Disclaimers of Warranties
Aside from the explicit commitments we make (such as our satisfaction guarantee, workmanship warranty, or any written warranty provided for a specific job), All-Air Heating & Air Conditioning’s services and website are provided “as is” and without any other warranty, to the fullest extent permitted by law. We disclaim all other warranties and guarantees, whether express or implied. This includes no implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Energy Production and Savings Disclaimer: All-Air Heating & Air Conditioning makes no guarantees regarding the amount of energy your solar system will produce, your utility bill savings, HVAC energy efficiency savings, the duration or amount of solar incentives or rebates, future utility rates, or the financial return on your solar or HVAC investment, except as may be explicitly stated in writing in your installation agreement. Energy production estimates and efficiency calculations are projections only and not guarantees.
Limitation of Liability
Limitation of Damages: To the maximum extent permitted by California law, All-Air Heating & Air Conditioning (including our owners, employees, technicians, and affiliates) will not be liable for any indirect, incidental, or consequential damages arising out of or related to our services or your use of our website. This includes, but is not limited to, lost energy production, higher-than-expected utility bills, lost tax credits or incentives, or other economic losses. We are responsible for the services we perform, but not for broader consequences outside of our control.
Cap on Direct Liability: If we are found liable for any claim arising from our services, our liability will be limited to the amount you actually paid to All-Air Heating & Air Conditioning for the service in question.
Exceptions: The above limitations and exclusions will not apply to the extent they are prohibited by law. We do not exclude or limit liability for gross negligence, willful misconduct, or any injury to a person or damage to property caused by our negligence.
Communication Policy (Texts and Calls)
How We Obtain Consent: All-Air Heating & Air Conditioning obtains consent to send text (SMS) messages through verbal opt-in during service scheduling phone calls. When a customer calls to book a service appointment, our Customer Service Representatives ask whether the customer would like to receive text message updates regarding their appointment and service status. Customers who verbally agree are opted in to receive SMS notifications. Consent to receive text messages is not a condition of purchasing any service from All-Air Heating & Air Conditioning.
Types of Messages You May Receive:
- Appointment confirmations and reminders
- Technician en-route and estimated arrival time notifications
- Service status updates (e.g., parts ordered, parts arrived, job scheduled)
- Estimate and invoice notifications
- Maintenance and membership plan reminders
- Installation progress updates, permit approvals, and utility interconnection status (for solar projects)
Message Frequency: Message frequency varies based on your service activity. During an active service appointment, you may receive 2–5 messages. Maintenance reminders are sent bi-annually or as needed based on your membership plan. For solar installations, you may receive more frequent updates during the active installation period to keep you informed of project progress.
Message and Data Rates: Standard message and data rates may apply based on your mobile carrier plan. All-Air Heating & Air Conditioning is not responsible for any charges from your mobile carrier.
Opt-Out: You may opt out of text messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message and no further text messages will be sent. You may also opt out by calling us at (209) 368-4264 or emailing partners@allairsolar.com. Opting out of text messages will not affect your ability to receive services from All-Air Heating & Air Conditioning. We may still contact you via phone calls or email to complete requested services or provide critical service updates.

Dispute Resolution and Governing Law
These Terms and any disputes arising out of your relationship with All-Air Heating & Air Conditioning will be governed by the laws of the State of California. You agree that any legal action shall be brought in the state courts of California, and you consent to personal jurisdiction therein. If any provision of these Terms is found invalid, the rest remains in effect.
Updates to Terms
We may update or modify these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the “Last Updated” date. Continuing to use our services after an update constitutes acceptance of the new Terms.
